History of the German Prosecution Service

The German Prosecution Service can trace its roots back to the early days of the German Empire. In 1871, the Imperial Criminal Code established the office of the Public Prosecutor. The Public Prosecutor was responsible for investigating and prosecuting crimes against the state. Over time, the Public Prosecutor's office expanded its responsibilities to include all crimes.

In 1949, the Federal Republic of Germany was founded. The new constitution guaranteed the independence of the judiciary, including the Prosecution Service. The Prosecution Service was given the responsibility for investigating and prosecuting all crimes against the federal government and its citizens.

Structure of the German Prosecution Service

The German Prosecution Service is a hierarchical organization. The highest-ranking prosecutor is the Federal Prosecutor General. The Federal Prosecutor General is appointed by the Federal Minister of Justice. The Federal Prosecutor General oversees the work of all other prosecutors in Germany.

Below the Federal Prosecutor General are the state prosecutors. The state prosecutors are responsible for investigating and prosecuting crimes in their respective states. The state prosecutors are appointed by the state governments.

The local prosecutors are the lowest-ranking prosecutors in the German Prosecution Service. The local prosecutors are responsible for investigating and prosecuting crimes in their respective districts. The local prosecutors are appointed by the district governments.
